I just received a summons I am being sued by a credit card company I know if I don't answer this summons a judgement will be issued against me, what can the company do to collect this money I do not own my home the only money in my checking account is my disability and my husband's social security check.Answer:
Basically speaking they can't do a thing to you except hurt your credit even more than it already is. Government pension money cannot be garnished by anyone other than the government itself. Be that as it may, I would be certain that the bank is well aware that all the money in the account is from government pensions and cannot be garnished. Banks are supposed to know that your account cannot be garnished but I think it best to actually go to the bank and make sure that they are well aware of it and will not accept garnishments on your account. But please tell me a little about the credit card account who has filed suit against you. First of all, what state do you live in? What credit card company are we talking about here? How many days do you have left within which you must file a response to the summons? Who is the plaintiff? The credit card company itself or some 3rd party debt collector? Are there any affidavits in the file they sent you? If so, who is the affiant and who is the notary before which the affiant swore? What state is the Notary from? All these are important questions if you want to respond to the summons in order to at least prevent a default judgment.
