Stopping Yet One More Arizona Insult to Ms. Giffords

Rate: 50 Flag
The Washington Post reports there are those in the Arizona legislature prepared to resurrect an old and obscure statute that says that when an elected representative is unable to fulfill his or her duties for three months (for any reason) the position may be considered vacant. In Ms. Gifford's case, this could mean that the mean-spiritednes that has laid her low could conceiveably keep her down despite what appears to be the beginning of a remarkable recovery. To be sure, there is not anything like unanimity on the issue;  AZ Law School constitutional law expert Paul Bender says that the law could not apply to Representative Giffords because she is a federal and not a state employee. Nonetheless, given that the issue has been raised in government circles in the state, I think it behooves, and immediately, people such as Senators McCain. Kyl, and Arizona Governor Brewer as well as Tom Horne, the state Attorney General, to quash immediately any further talk of this. If these people are sincerely seeking a new, more upbeat, way to talk about public issues, they should straight away disassociate themselves from any such peevish idea.

Hear! Hear! Missed you last week, Jon. All OK?
Bring on whatever special sessions of their legislature that are necessary. Surely the law never anticipated such a situation as hers. Decency indeed...Godspeed, Gabby! Welcome home, Jon! r
Muse my bet it gets nowhere but these people should condrmn the idea now.
Isn't it something of a novelty to ask decency of politicians?
"Decency." Such an odd, old-fashioned word...:) ~r
Jan I'm a novel fella. :)
Well, Joan, as I implied to Jan, I am Old School. :)
Jon: I heartily agree with your comments, but I also agree with Jan Sand's comments. A decent politician...oxymoron? R
Dave that's why they have us...to help the decency along.
Was there some sort of newsletter sent out that suggested that all assholes in the country need to move to Arizona? Seriously, what is that all about?
Odette-- can seem that way.
I hope the Post can put some names to this disgraceful maneuvering. This is so appalling that should it come to pass, surely it would backfire.

Glad to see you're back from the disease of kings JW.
Abra I'm pleased to be bck. And yes, I'd hope it'd go nowhere.
Incredible. I hope that we can see who is behind this and that are mightily disgraced. Welcome back by the way!
Sheila thanks!
I'm hoping this nonsense doesn't get far at all.
Welcome back. Good points.
sophie thanks on both counts :)
This is insane..where are their minds?:(
rated with hugs and so glad to see you back

Yes I read about it in the Washington Post this morning, it's disgusting. Reactions from the Republican (Federal) representatives should be interesting in AZ. Will see where the surveyors sight leads.....o/e r{++++
Anyone who'd push this legislation would be committing political hari kari. One would think.
"the mean-spiritednes that has laid her low "

Oh yes, Jared was one mean-spirited dude.
Welcome back, Jon, I mised your presence. Aren't those who push for such legislation, in some way, owning upto the crime?
Gordon and in the minds of those using her sadness to seek undeserved sympathy
These are the same people who call American kids Anchor Babies and want to change the constitution. It really makes you think that in a Bizzaro World, they had it done. But, thats only in a Bizzaro World, right?
green 1 would think, yes
Jon, welcome back! As you know, I have missed your contributions - and you. Take care...
FusunA thanks so much :)
Catherine Thanks, friend!
Good to see you back, weighing in on the scene.
It is tacky behavior. It is not unexpected that this would come from a state that steadfastly refused to recognize MLK day. I have a guilty pleasure in that the state is being "reclaimed" by Mexico.

Glad you are back. I hope it was a vacation and you enjoyed the rest.
Constitution--
Article 1, Sec 4-- The times, places and manner of holding elections for Senators and Representatives, shall be prescribed in each state by the legislature thereof; but the Congress may at any time by law make or alter such regulations, except as to the places of choosing Senators.

That election was already completed.

Art 1 Sec 5 first sentence-- Each House shall be the judge of the elections, returns and qualifications of its own members

The Arizona lege has no say in the matter. Brewer has already poo-pooed the idea.
Why am I not surprised at this?
I'm cautiously optimistic re Ms. Gifford's recovery. Her colleagues are lame ducks. Shame on all of them.
1. I agree
2. This was my first worry, that Rep. Giffords would be replaced for being unable to serve out her term; that, due to the realities of state politics, the seat would switch parties; and that other nutcases would learn from this that assassination is a viable, if self-sacrificing, way to change the elected balance of power in Washington, leading to the increased use of assassination by the fringes as a viable political tool. My own solution was to introduce legislation stating that if an elected federal official wasn't able to finish out their term due to an act of violence, their replacement must be from the same political party, which would pull a lot of incentive out of assassination. Old New Lefty tells me that many states already have such a law on the books. I don't know the overall status of this but, if Rep. Giffords is replaced, this is going to get really, really ugly.
Well intended post but much ado over the noise surrounding the attack.
It won't happen, as noted here by P.J. O'Rourke
Thanks for reporting this, Jonathan. But I don't expect that it will go anywhere.

Rated.
Whether it goes anywhere or not, the very speaking of the idea is indecent.

Lezlie
Jonathan, you should have looked up the facts before you posted this. I can only presume that you just had a need to smear some people.
Blackflon presume away....
Also, Paul, et. al.: I agree it won't likely have legs and that Ms Brewer seems to be offended by it is fine buty a con law man as honorable and wise as Paul Bender commenting on it at all tells me that there are those who would try to use such a statute to advantage.
Kosh I am at least tentatively persuaded that federal law is what's important here no matter what a few scoundreld in AZ or in DC may want.
Kyl, McCain and Brewer are the Three Stooges, only not funny.
Johnathan,
Given Arizona's dismissal of the Constitution on illegal immigration, etc, I wouldn't be surprised. However, I doubt that even the most creative "conservative" judge would dare to agree.
Jeez.... but none of the conservatives are responsible in any way for the shootings.... yep.... whatever.
"Gordon and in the minds of those using her sadness to seek undeserved sympathy"

I really don't know what this is supposed to mean. A verb would help.

Your gift for understatement is really quite remarkable. But I suppose that if Giffords was laid low by mean-spiritedness, it's not that much of a stretch to say that a bullet through the brain causes "sadness."

Compared to Pelosi, Reid, and Schumer, McCain, Kyle, and Brewer make the Three Stooges look like the Holy Trinity.
The three stooges being gorgon, blackfoam and catnliar.

-R-
Gordon you forget-- that trio Took The Last Train for the Coast, 2/3/58.

Up to us, now.
Talk about adding insult to injury. Even the most craven of politicians wouldn't dare, if only for PR reasons. A giant raspberry to those who'd even raise the subject. Thanks for this, Jon, though it raised my BP.
Sally as much as Los Tres Amigos, aqui...may applaud it, I, too, doubt it will come to pass.
Another bad idea from the "Bad Ideas State."

As one who also suffers the occasional gout attack, I welcome you back.
I've heard many a right wing bloviater go on about how the liberals are being mean by taking a politically opportunistic line because of the Arizona shooting. Therefore, I'm sure that 100% of all conservative Arizonans would be aghast at using such a ploy for opportunistic advantage. ;(
Decency and politicians?
agreed and r. Hope you're doing better and are well.
Crank, Lefty, Fay, Sally, RW thanks to all of you.
It is an atrocity that never should have reached a human ear! I am simply blown away as she makes a remarkable recovery such a thing is even being entertained by anyone!

Welcome back, I have missed you!
Absolutely. You just answered a question we had about what would happen to her position while recovering. Thanks rated
