"Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," Judge Stephen Reinhardt wrote in the majority opinion.

SAN FRANCISCO -- The U. S. 9th Circuit Court of Appeals on Tuesday has upheld a ruling made by former U. S. District Court Chief Judge Vaughn Walker in August of 2010 that California's Proposition 8, the 2008 voter-approved ban on same-sex marriage, is unconstitutional.

      The court also rejected arguments by the defendants -- ProtectMarriage -- that Walker should have recused himself because he is gay, and was living with his long time partner. In their appeal, defendants argued that Walker's sexual orientation influenced his decision to strike down the ban. Walker confirmed in April 2011, eight months following his ruling, that he is gay.

With this decision by the 9th Circuit, the proponents of Prop 8 will appeal to the U. S. Supreme Court which most likely will hear the case in the 2013 term.

The US Supreme Court is very conservative, though, is it not?

Woot woot!!! I lived in CA when Prop 8 was passed, and I felt like I was abandoning the gay rights movement when I moved away. I was so proud when the original vote allowed gay marriage, and then so ashamed when prop 8 passed. One more step to the Supreme Court, but we know where Scalia, Thomas, and Roberst will stand, so I'm nervous.

Fire I think Mr. Justice Kennedy can be persuaded by 14th Amendment Equal Protection arguments. We may well win 5-4.
my advice to people who don't want to see gays marry is to attend a church which reflects your viewpoint, and take comfort that the person in the next pew shares that opinion.

government has no more role in preventing gay marriage (or polygamy) than it does in requiring women to cover their hair, how long a mans beard should be, or deciding what is a church and what is a nut-case cult.

end the "non profit" status of all churches in america. they aren't functioning as charities. they're simply social clubs for people with like minded views.

Democracy anyone? - Not that I think Gays shouldn't be allowed to be civil unioned by the state and married by their church (as should EVERYONE), just that, as usual, principle is determined by the Ox Gore method. ( Which beats the Al Gore method of dictatorship by an "intellectual elite", but still------ )
Token if you don't think the Ninth Circuit ruled based on the law, you may wish to take it up w those justices.

Lezlie that won't likely occur until the next Court calendar, in 2013.
Although I think the Court would prefer to avoid it, they may have no choice now but to take that case, given contrary rulings in other Circuits, if the full Ninth Circuit affirms, not a small if.
I do find it mildly amusing that the one dissenting vote came from a G. Bush appointee who attended Brigham Young University

Glad to hear this today- with a good analysis from Nina Totenberg on NPR. Good news, but not the earth shattering bomb. Still a long way off from equal rights in California- or the rest of the US- maybe another 6 months or a year before the Supreme Court will hear this- if they do. If they don't, then it changes the law in the 9th Circuit states, if they do- then come hell and high water for the rest of us!
Ori the Court will almost certainly hear and rule on the case in its 2013 term.

Wouldn't the same logic apply in saying that the straight judges should have recused themselves for the same reason? The people wasting money on this issue/non issue, should have to go down to the streets and tell hungry, homeless kids why this is more important than keeping them fed and sheltered.

I don't take up "Rulings of law" with "Justices' anymore than I take up opinions of theology with pit bulls. I merely note that people ( Both left and right) are all in favor of "Democracy" up until 51% of the people want something that they view as a "violation of their tights". That's why we are a Republic, not a democracy.

All have a right to be civil-union ed by the state, but the state does not have the authority to grant the sacrament of "marriage" to anyone. sacrament is by definition a church function. we've been over this before.

All the ruling does is, once again, demonstrate that anynumber of monkeys in black robes showing their butts by having climbed a flagpole, do not a "justice" make. it diminishes any respect the courts still have. (Not much).

i don't contest the rulings of courts, I look for the ample opportunities to ignore them- like the president, like everyone else these days. Courts have become objects of ridicule. As has the rest of our "government".
