I have had the unfortunate experience of dealing with a mother with dementia and a brother that is utterly cruel and dishonest. Adding insult to injury I have just dealt with a court system that is only geared to take money from the ward (victim) for themselves and the state. My brother, his slimy lawyer, the ad litem lawyer appointed by the court and the court all made out like bandits handing down a decision that a junior high student could see is filled with fraud, ignoring the constitution, the law, and last but not least the wishes of the ward/victim in question, my mother.

      Just as an example of some of the outrageous points in the decision;

> Mrs. Derrick shall remain in the nursing home..

this was arrived at without any competency hearing or evidence which is a violation of her constitutional rights

>I as chosen POA (power of attorney) which is supposed to be first consideration of conservator, was simply ignored, which is done all the time, her affidavit to the judge saying she absolutely did not want my brother in charge of anything, ignored by the judge, and her doctor and lawyers declaration of compentency completely ignored by the judge.

>co-conservatership was declared for me and my brother, my POA they could not find a legal ground to deny stayed in place. co-conservertorship with one being POA? Really? This is crazy.

>my mothers money would pay the thousands of dollars cost incurred to my brothers attorney, and the attorney ad litem, even though she did nothing to bring this on herself and her choice in POA stood.

     The upshot is this; in this small town my crooked brother and his crooked lawyer and the crooked court made a sham of the law. I am sure they are there calculating the next step in this ongoing crime.

      The real utter hopelessness here is that these courts everywhere everyday in your town, city and mine are ripping off the elderly of thousasnds or tens of thousands of dollars in court costs. And if one is naive enough to appeal, then what happens is a crooked appeals court that upholds the crooked court. Is some of this money going to the judges? Yes. There are cases "under investigation" all over the country. And if a lawyer wants to keep playing ball in that court he goes along with the system at the client/wards expense cutting deals and making money. There is NO OVERSIGHT! They are breaking laws, making laughable decisions that are blatenly illegal with NO ONE to hold them responsible. They are ALL above the LAW because they own the law.

       If you have an immoral sibling you had better get in gear and figure out with your parent(s) what to do to safe guard as best you can against this unbelievably corrupt court system in this country.
