Cannabis Is Still Illegal EVERYWHERE In The United States

Dear Washington State Stoners,

Please remember that despite any statewide vote that did or did not pass, cannabis (in all its forms) will remain ILLEGAL on December 6th, 2012. Ya see, there's this pesky clause in The US Constitution called the Supremacy Clause which gives the federal government ultimate jurisdiction over all things for which they have made laws.

In case you think the feds aren't an issue, the Obama DOJ has arrested, prosecuted and convicted more people under Federal Drug Scheduling laws (20 year sentence for ANY amount of a Schedule 1 substance) for the chronic than any other administration's DOJ in the entire history of the US. He broke the previous record holder, GW Bush's, record in 3 years.

And, just in case you think it still isn't a big deal, the arrests have been primarily in CA and CO, the two states who, before WA's law passed, had the most liberal cannabis laws on the books (WA replaces CA, but because CO passed a similar ballot initiative, they stay in the same spot.  Weed will be "legal" in CO sometime in the next 60 days).

Dispensaries tend to be the biggest target for busts, so if you can still have your regular weed guy or girl deliver, I'd highly recommend it.  The only problem with that plan is that the state is looking to make some dough here through taxation, so black market weed, while not contraban in and of itself, represents tax fraud which usually carries a 1 year sentence for first time, low level offenders, which is more than the current penalty for anyone caught with under 40 grams of the reefer.
 


BE CAREFUL, YOU CRAZY STONERS. More people are gonna get locked up for a lot longer now that weed is "legal" than they ever did before this ballot initiative passed.

The Justice Department said it was reviewing the initiatives but would not comment further on how it would respond. A spokeswoman for the Drug Enforcement Administration said that its enforcement of federal law, which bans production, possession and sale of marijuana, “remains unchanged.”

It's not legal. It's decriminalized...even on the state level. Giving drug companies the ability to produce stronger and more addictive versions of a drug scares the shit out of me. It's the only part of decriminalization that does.

This is the part that no one seems to mention...the Feds can come in and toss you in jail, regardless of what your groovy state says...

Somehow I got focused and busy on pot -- I am a scattered ADD--riddled brain without it...just like what I've heard other people say smoking pot is like : )

Here in Oregon, I suspect the pot measure was voted *down* by the growers and the smokers: more oversight, less potency, certainly not organic if given oversight by legal entities/drug companies -- the opposite of your thoughts, I think.
What's out there now is so intensely strong, even grown to enhance the speedy part *or* the stoner part, so many different strains, all given crazy names, the special bumper harvests collected and treasured like wine connoisseurs -- these guys are botanists, business majors -- the pot growers out here aren't spaced-out flakes, they are in competition with each other to grow evermore amazing pot.
So many can grow indoor or medicinal now that you have to be an excellent gardener to get top dollar....

Federal law on weed is stupid, the DEA knows it's stupid and if folks stay on the low down the feds could give a shit. The busts that they've run down in California have been primarily aimed at activists and "dispensaries" that are pulling down profits in the millions... the law in California was intended for small non-profit co-operations that grow and harvest the legally allowed twenty plants for each registered user. What's happened in LA and other metro areas is former dealers filed for their licenses, opened up shop and are raking in the big bucks based in the expectation that their lawyers can get the case thrown out in state court; ergo the Feds step in when the local LEO's ask them to. I got nothing against selling weed, but I'm damned if I'm gonna pay anyone over $10 an ounce. These "non-profit"dispensaries are asking from $40 to $200 for their primo shit!! Greedy fucks should be busted!!! Now if we can only get the feds to go after Bof A and Wells Fargo.

You are in Lexus Land, pot is top dollar -- it costs to grow really good pot: you are paying for overhead, supplies, security, "employees," risk, on and on -- they figure cost just like any other business (I assume) -- or they won't stay in business.
And I am talking about smaller growers who are following state limits to the letter of the state law.

Of course, even the leaf trimmings out here is likely more potent than that old East Coast Brown...
I spent a career defending people charged with various drug offenses in federal court. Since every one of those folks was guilty of the charges set out in at least one of the 56 counts in the Indictment lodged against them, I became somewhat knowledgeable in the sentencing aspect of all of this.

How the weed is consumed and by whom it is consumed is still of tremendous importance to the feds. We saw an analogous situation in connection with cocaine. Crack cocaine users or dealers were always sent up for far longer stretches than powdered cocaine users or dealers even when the quantities of cocaine at issue were identical.

I think that middle class consumers of weed who take their marijuana baked in brownies are undoubtedly going to be treated more leniently in the federal courts than lower class consumers who prefer to fire it up in blunts.
Just Thinking - it's puff-pass, not puff-puff-pass. Them's the rules. I didn't make them. Everyone knows them, so when you're consistently breaking them (not everyone who double tokes is a double toker), you're an asshole.

Brassawe - Obama recently reduced the penalties for Crack, making them only 4 times more than powdered cocaine (but base is the same as the salt form of cocaine, which is stupid because crack is ghetto base).

I'm sure as a practical matter, for the purpose of a plea bargin, it matters, but the Drug Scheduling Laws are clear - 20 years for any amount of a schedule 1 drug.

As far as I know, if it goes to sentencing, judges have no discretion...

The only growing scenes I've ever heard of around here were a few years ago, but they were all about organic and light-on-the-Earth type folks -- "peace, love and light through 'higher' living."
In Humboldt I've heard cartels have moved in, nasty chemicals everywhere, guns, scary forests for hikers....if that's what you're referring to. No surprise if they're moving north.
Not my world anymore, and I never grew, but I sure smoked a lot --- and I'm sure the evil contingent shows up and makes things scary and all wrong, anywhere money is to be made.
