Kansas SoS Kobach, MOVE and Disenfranchising voters

When Kansas Secretary of State Kris Kobach came out yesterday with the announcement that the Kansas State Board is considering removing President Obama from the ballot in Kansas he very publicly violated the law known as MOVE.  MOVE is the Military and Overseas Voter Empowerment Act of 2009 and it specifies the date by which electronic and paper ballots be available.   MOVE also specifies that paper ballots and electronic ballots be identical.   These two things are critical.  

This year MOVE specifies electronic Ballots be emailed to all military personel whom election officials have received an absentee ballot application from after January 01, 2012 (for any election) be sent sent electronically prior to midnight on September 12, 2012.   MOVE specifies that all paper ballots which election officials have received an application for be mailed no later than midnight September 22, 2012.  

Yesterday, when the announcement was made, was September 13, 2012... the day AFTER the law requires electronic ballots be sent to military and overseas voters. 

Now, given that Kris Kobach is an "unofficial advisor" to Mitt Romney, and given that he publicly endorsed Mitt Romney for President and given that he's publicly considering removing President Obama from the ballot in Kansas I have a couple valid questions for Kansas voters.  

1.  Did you know it's a Felony for ANY election official (including the Secretary of State) to publicly endorse OR vilify any candidate or issue on the ballot in the state where they are an election official?   

2. Did you know the highest election official in EVERY state is the Secretary of State? 

3. What are you going to do come November 21st when SoS Kobach certifies the election results - in direct violation of Federal Election Law?  

4. Are you aware that his actions have the potential to disenfranchise EVERY voter in the state of Kansas because the FEC COULD throw out EVERY vote in the state due to his illegal actions?

Thanks for laying this out. This seems only the latest crackpot attempt by Republican state officials to rig the election. Neither the law nor court orders seem to mean much at all to these reckless and cynical ideologues, inlcuding Ohio's Jon Husted, who's still defying court orders, and Colorado's Scott Gessler, who hasn't quit trying to purge voters and encourage organized intimidation at the polls in November. [ My recent 4-part posts on voter suppression detail these acts]. I see them just shifting gears, trying new tactics, new subterfuges, new evasions, new crackpot rationalizations with an attitude that says "try and stop me." They seem indifferent to the consequences of creating an illegitimate election. [r]
Another shame on you to the state of Kansas who, go figure, is guaranteed this year like very other election year, to vote Repub for prez... So, why? Why? Why? Assholes (and I do hate the electoral college)
