ecently Dateline NBC did a multi part expose on the horrors that occur in the debt collection industry. The series was very good and covered many different facets about how consumers get taken to the cleaners by dishonest lying debt collectors who will stop at nothing in the process of intimidating unsuspecting victims into submission.  Chris Hansen also inteviewed Elizabeth Warren the Harvard Law Professor and a legal authority on consumer debt issues. The series and the interview with Professor Warren neglected to cover what is even more damaging and more lethal than those annoying phone calls. As I have said many times and in many ways, its easy to stopthecalls but stopping the lawsuits is a stone that both  Mr. Hansen and Professor Warren left unturned. I emailed Mr. Hansen about what I have just said but have not received a reply.

Below I have inserted a real document that was submitted by a plaintiff recently in a motion for summary judgment.  The plaintiff actually had the chutzpah to assert that this bill  of sale proved that their client purchased the defendant's defaulted credit card account. Please tell me where the letterhead is on this bill of sale, where the notary seal is, where the identifying account information is? Pretty funny isn't it? It is only funny because I was able to help the defendant file an answer which exposed these scoundrels for what they really are..liars, cheats, and white collar criminals who get away with this kind of stuff every day of the week because the courts don't care unless you make a stink or the defendants are ignorant of their rights.

Suits with fraudulent documents which are concocted by old debt buyers or third party debt collectors are filed with regularity. Thankfully there is legal precedent which has thwarted the use of  fraudulent affidavits but you have to know the cases involved when you file an answer in these actions.  As you examine the document below I think it is apparent how phony it looks.
