Ok. you win. I won't come over to Beavercreek anymore. You've scared me off. If you enjoy having a pack of ( Haven't decided yet whether they more resemble Rabid Coyotes or Cub Scouts on a testosterone high) “Police” who protect you from the the homeless and the less than middle class, you've made your point.
Last week, Tuesday July 3rd, two of your police detectives, one named “Curd”, came over to Fairborn to arrest a neighbor of mine on a bench warrant for missing a trial date. The trial stemmed from a ludicrous incident in your fair city on September 11, 2011. no need really to go into it, the case is Fairborn Municipal Court TRC 1108700 and you could review it on line, it's a public record, except wait-- it apparently has something to do with national security so it is not available to be reviewed even by the likes of the city manager of Fairborn ( YIKES!!! Must be some powerful secrets in there!!!)
Anyway, I've been trying to help my neighbor out, since he is bi-polar and has a disability pension from GM ( at one time he was as productive as you are- more productive than me) , and is just about 12 years old when it comes to dealing with authority ( Deer in the Headlights) He hasn't been able to get a Lawyer because he “makes too much money” to qualify for a public defender, yet he hasn't been able to accumulate the minimum $2500 that any “defense” attorney in this area needs to be presented with up front before he will deign to discuss a DUI. ( Yes it's a DUI, the ludicrous part is that my neighbor hasn't driven since 2008, and I'll make a small bet with you that if you put him behind the wheel and asked him to drive a block, he'd hit something before he got there) ( Long story short, he was riding with a “Friend” who left the scene ( and his car) in order to avoid an OMVI- and charging the actual driver would have involved annoying a “prominent” Fairborn Woman ( Her 43 year old live at home son was driving) who can and has made sure her baby boy has an attorney when he needs one ( which is often).
Where was I?
Oh yes, anyway, the officer ( That would be D. Holy of Beavercreek PD) decided it was just altogether less trouble to stick it to the feeble minded guy, he won't fight it. And your champion of Justice Betsie (Little Ms) Deeds, your assistant prosecutor, concurred and charged my neighbor, even though she had no evidence , NOT EVEN AN ALCOHOL BLOOD OR BREATH TEST !! ( Holy apparently forgot to administer one--- oops)
Anyway, I've apparently been annoying Little Ms Deeds to the extent that the detectives who picked up my neighbor on the 3rd felt that they had to show him a picture of me and ask if he knew me.
My Neighbor said “That's my neighbor Bob!” ( Let's just assume it was detective Curd, because his name is on the arrest report) said “You need to tell him to stop what he's doing”, My Neighbor said “What's he doing?” Detective replied “ He knows what he's doing, and you need to tell him he'd better stop, or we're coming after him”.
My neighbor told me about this on Thursday. I called your cop shop and found myself talking to Capt. Wright. He, of course, didn't believe a word of it. I asked him why one of his detectives would have my drivers license photo, because it's my understanding that accessing such records is illegal except on official business. He said there was a complaint against me. I said from whom? he said “ The prosecutor's office” , he proceeded to tell me that I was welcome to come file a complaint against his fine upstanding officer's, but implied that probably they'd look into the complaint against me at the same time.
Wowser!!!! not exactly a good time to go complain to the Beavercreek Police!!!
Next morning I took my neighbor to Fairborn Municipal court for his arraignment and while I was there, I asked the clerks office what sort of complaint had been filed against me from the prosecutor's office. They couldn't find one. The clerk helpfully suggested that it might be on record with the Beavercreek PD, and not have been posted to the court yet.
Went home and called Beavercreek PD. Records dept. No record of any complaint. Uh Huh
I told the record guy to put Wright on. He said That's “CAPTAIN wright” I said that I really didn't care if he was a corporal a captain or a Reichs Marshall, I'm a civilian and I outrank him.
Wright came on I asked him why he'd lied to me. No real good answer to that. He went into “Perp Talk” Mode ( Surprise!- I've a degree in psychology, psycholinguistics specialty, am acquainted with the mode of speech we call “Perp Talk” which is when you catch somebody red handed doing something he knows he shouldn't be doing- and the response is Denial, Excuses, Threats and Rationalization- Perp talk) I said, I'm hearing Perp Talk now, he invited me to come down and file my complaint. I told him I'd see him in Federal Court.
I called a friend of mine who's a Lawyer in Cincinnati and got the name of a civil rights attorney.
I called another friend of mine who's a lawyer in Columbus and discussed the hows and why's of having Little Ms Deeds disbarred by the Ohio Supreme Court Disciplinary Committee for participating in a conspiracy to violate my civil rights by intimidation and threats of violence under color of authority in retaliation for and in suppression of my right to protected political activities and speech.
I went over and had a few words with the Fairborn Police Department and city manager about filing a complaint about the Beavercreek detective's having threatened me while he was in Fairborn. They wouldn't take the complaint. Said it was an internal affairs job for the Beavercreek PD. Fair enough. They want to stay out of it. I have no complaint with them, they are a pretty decent bunch of cops, and their Chief Barlow is an excellent man. Still making up my mind about the city manager.
All that to tell you, you've frightened me off. I was shopping at Fairfield mall and the stores on Fairfield road 2 or 3 times a week, making it into downtown Beavercreek about every other week or so. My wife and I ate in the restaurants there at least twice a week.
I've been frightened so badly by that detective's threat, that I no longer feel safe anywhere that is in the Beavercreek PD jurisdiction. I work with the homeless through my church in Xenia, we do homeless outreach, I did a homeless census in Greene County in February. Not surprisingly, Beavercreek has no homeless. The Beavercreek PD moves them out. Funny thing, I didn't run into a homeless person who didn't have at least one good horror story about encounters with Beavercreek PD and Fairborn Municipal Court. Huh.
At any rate, I will be shopping in Huber Heights from now on, and I will be networking with my church in Xenia, my neighbors church in Fairborn, my neighbors mental health therapist's network, my network of social workers, my friends among the merchants of Fairborn, and my friends on the base at Wright Patterson to make sure that everyone is aware and warned about how dangerous going into Beavercreek is. If it makes you feel safe to have your police department protect you the way they do, god bless you and more power to you. The merchants of Huber Heights. Fairborn, and Xenia thank you.
PS. Debbie McDonnell, fairborn's city manager wonders why I am interfering in this and don't just let the legal process “take its course” If She and Little Ms Deeds want to put up the $5000 in legal fees that it will cost my neighbor, I'm certain he would be delighted ( I'm sure I would) to see little Ms Deeds and Officer Holy explain to a jury and a packed courtroom just how this came about. Why don't you all call up and ask your assistant prosecutor Ms Betsie Deeds what is going on, I'm sure she would love to explain her side of things. Just to be fair.
